Recent Update from U.S. Customs:
Starting January 11, 2025, the U.S. Customs and Border Protection (CBP) will fully implement the 321 provision—regarding the "de minimis" exemption for low-value shipments. CBP plans to synchronize its systems to identify non-compliant importers.
According to Section 321 of the U.S. Tariff Act, low-value goods valued at less than $800 can enter the U.S. duty-free. For individuals or businesses mailing or shipping items from overseas to the U.S., if the declared value does not exceed $800, they are generally exempt from customs duties and related taxes.
Shipments eligible for the de minimis exemption must meet the following conditions:
The value of the goods is below $800.
The $800 de minimis exemption applies to each importer (company or individual) for daily import volumes.
Regardless of the mode of transport, shipments sent to the same importer will be combined as a single import. If the total value of all shipments exceeds $800, taxable customs clearance is required.
The importer must indicate the value of the goods on the bill of lading or similar documents (e.g., manifest).
All modes of transport, carriers, and entry types are included in the count.
If the value of imported goods exceeds the daily exemption limit, the shipment will undergo formal or informal customs clearance as determined by U.S. Customs. In such cases, U.S. Customs will impose duties and taxes. Additionally, please note that U.S. Customs charges a Merchandise Processing Fee on all formally declared shipments.
Please be aware that the $800 limit set by U.S. Customs is the daily exemption cap for each importer (company or individual). Ensure that you provide accurate, complete, and clear information regarding the value of each shipment to avoid delays or holds due to inaccurate, missing, or vague information.
